paid for a 56k modem(never received)

I paid for the modem on 6/7 via paypal and was told he would be shipping on the 9th or 10th, after receiving no communication, I pm'ed him on the 16th, on the 18th he responded with "Hey man, I sent it today" but provided no tracking #. I contacted him again on the 25th and he assured me he shipped it...sent pm 28th....no response....finally on the 30th I ran out of patience and asked for my money back, which he did respond to and returned my money(minus paypal fee's)...waiting 10 after payment before shipping is egregious enough by itself but his almost non-existent communication is totally unacceptable!

Communication was REAL slow. He said he would ship the next day. Then the next day came around and I had not heard anything, 2 days later he replied saying he shipped. Also phone was scratched a lot on the front. No previous mention of it tough.
